Your Rights as a Tenant, Homeowner, or Prospective Buyer in New York

The federal Fair Housing Act (also known as Title VIII of the Civil Rights Act of 1968), as well as the New York State Human Rights Law, protects your legal right to rent or purchase a home or apartment, get a fair mortgage, and receive homeowners insurance, regardless of your race, religion, sexual orientation, and so on.

According to the Fair Housing Act, landlords are not permitted to take any discriminatory action against tenants or potential renters. However, this doesn’t stop many from doing so anyway.

You may be a victim of housing discrimination if your landlord has:

  • Advertised or communicated preference for a certain type of tenant that would exclude people of other races, ethnicities, or other protected categories
  • Lied about a lack of availability of rental units
  • Implemented more restrictive tenant selection standards for people of certain groups or refused to rent to members of said groups
  • Changed terms, privileges, etc. or inconsistently applied policies to certain tenants on the basis of membership in a protected status
  • Terminated a resident’s tenancy on the basis of discrimination

As a prospective homeowner, renter, or recipient of a housing loan, you have certain rights, including:

  • The right to be evaluated on the basis of your financial track record and history of stability as a tenant, rather than on the basis of previous personal or emotional health issues
  • The right to fair pricing on rental units and homes
  • The right to fair rates on mortgage loans and fair evaluation of your financial track record
  • The right to live free from sexual harassment or threat of sexual violence
  • The right to live in any place you wish, regardless of your gender or sexual identity
  • The right to privacy and freedom from questions by your landlord about your illness, disability, etc. (This means you are NEVER required to relinquish medical records.)
  • The right to reasonable accommodation for disabilities by your landlord

As an experienced New York housing discrimination lawyer, Attorney Mahir S. Nasir has the skill to represent you well and seek justice on your behalf. Our entire team understands the unfair consequences of discrimination on your life, and we are here to protect you to the best of our ability.
